Hereinafter referred to as the “Service Provider”. The Service Provider operates the online store under the name Gourmet Moments (the “Webshop”).

2. Scope, acceptance and availability of these Terms

2.1. These Terms and Conditions (the “Terms”) apply to the use of the Webshop and to sales contracts concluded between the Service Provider and any person purchasing through the Webshop (the “Customer”).

2.2. Before finalising an order, the Customer must read and expressly accept these Terms and acknowledge the Privacy Policy. Acceptance is given by selecting the relevant checkbox; pre-ticked checkboxes shall not be used.

2.3. The version of the Terms in force when the order is placed forms part of the contract. The Service Provider makes the Terms available in a manner that enables the Customer to save them and review them later in an unchanged form.

2.4. The language of the contract is Hungarian. If the Service Provider publishes an English translation, the Hungarian-language version shall prevail in the event of any discrepancy in interpretation, unless mandatory law provides otherwise.

2.5. By using the Webshop or placing an order, the Customer confirms that they have understood and accepted these Terms.

3. Definitions

Consumer: a natural person acting for purposes outside their trade, business, craft or profession, as defined by the Hungarian Civil Code.

Business Customer: a natural or legal person, or an organisation without legal personality, acting within the scope of its trade, business, craft or professional activity.

Product: wine, sparkling wine, semi-sparkling wine, non-alcoholic beverage, gift package, accessory or other goods offered for sale in the Webshop.

Distance contract: a consumer contract concluded between the Service Provider and the Consumer without their simultaneous physical presence, using exclusively one or more means of distance communication.

Business Day: a day regarded as a working day under the general working schedule applicable in Hungary.

4. Use of the Webshop and conditions of purchase

4.1. Anyone may browse the Webshop. Alcoholic products may only be ordered and received by persons who have reached the age of 18.

4.2. The Customer must provide true, accurate and up-to-date information. The Service Provider shall not be liable for delays, failed performance or additional costs resulting from incorrect, incomplete or false information where the cause is not attributable to the Service Provider.

4.3. Purchases may be made through a registered account or, if made available by the Webshop, as a guest.

4.4. The Customer is responsible for keeping the login credentials of their user account confidential and must immediately inform the Service Provider if unauthorised use is detected.

4.5. The Service Provider may reject or cancel orders that are manifestly abusive, fraudulent, unlawful or technically harmful.

5. Alcoholic products and age verification

5.1. It is prohibited to sell or supply alcoholic beverages to persons under 18 years of age. The Service Provider therefore sells alcoholic products exclusively to adult Customers.

5.2. On entering the Webshop, visitors must make a declaration through an age gate confirming that they are at least 18 years old. Before finalising the order, the Customer must separately confirm, by selecting “yes” or “no”, whether they have reached the age of 18. Alcoholic products may only be ordered following an affirmative declaration.

5.3. Gourmet Moments offers wine and other alcoholic beverages as accompaniments to occasions and shared experiences and consistently supports responsible, moderate alcohol consumption. The Products are best enjoyed consciously and in moderation. Alcohol consumption is prohibited or should be avoided during pregnancy, while taking medication, when driving or operating machinery, or where a health risk exists.

6. Ordering process and formation of the contract

  1. The Customer selects the Product, places the required quantity in the basket and reviews the basket contents.
  2. The Customer provides billing, delivery and contact details, selects the delivery and payment method and reviews the total amount payable.
  3. Before finalising the order, the Customer may correct data-entry errors and modify or remove items from the basket.
  4. Clicking the “Order and pay” button, or a button with equivalent wording, constitutes an offer involving an obligation to pay.
  5. The Service Provider acknowledges receipt of the order by an automatic confirmation email. This confirmation does not necessarily constitute acceptance of the order.
  6. The contract is concluded when the Service Provider accepts the order in a separate email or sends a dispatch notification, whichever occurs first.

6.2. If the automatic confirmation is not received within 48 hours after submission of the order, the Customer shall no longer be bound by the offer unless the parties agree otherwise.

6.3. The Service Provider may reject an order for justified reasons, including lack of stock, an obvious pricing error, payment risk, a legal impediment, an age-verification issue or previous abuse.

6.4. In the case of an obviously incorrect price, such as HUF 0, HUF 1 or a price strikingly different from the usual market price of the Product, the Service Provider is not required to perform at the incorrect price. The Customer will be informed promptly and may be offered the opportunity to place the order at the correct price.

6.5. The contract is concluded electronically. The Service Provider retains order and invoicing data for the period required by applicable law. The individual contract text may not be separately archived as a standalone instrument, but the order data and the applicable Terms remain retrievable.

7. Products, descriptions, vintages and availability

7.1. The Service Provider endeavours to ensure that Product descriptions, images, prices, alcohol content, volume, origin, allergen information and other material characteristics are accurate. Product images displayed in the Webshop are for illustrative purposes. The wording, vintage, label, capsule, bottle shape or packaging shown may differ from the Product currently supplied. The actual appearance may differ due to screen settings, photography and changes introduced by the producer. For the purposes of the order, the Product name, vintage and material characteristics stated in writing on the product page shall prevail.

7.2. In the case of wine, the vintage is a material characteristic of the Product. The Service Provider supplies the ordered vintage. A Product may only be substituted with a different vintage with the Customer’s prior express consent.

7.3. The label, capsule, bottle shape, carton, gift box or other packaging element may change at the discretion of the winery or manufacturer. Where the change does not affect the identity, quality or material characteristics of the Product, the image displayed on the website shall be regarded as illustrative. The Service Provider will consult the Customer in advance in the event of a material discrepancy.

7.4. Artisan, natural, organic or minimally interventionist wines may contain natural sediment, slight haze, crystalline deposits or minor bottle-to-bottle variations. These characteristics do not necessarily constitute defective performance where they result from the nature of the Product and the Product remains fit for consumption.

7.5. Stock information is indicative. If an ordered Product becomes unavailable, the Service Provider will refund the amount paid or, with the Customer’s consent, offer a substitute Product.

7.6. The Service Provider may apply quantity limits per person, order or period, particularly for limited vintages and promotional Products.

8. Prices, taxes, discounts and coupons

8.1. Prices displayed in the Webshop are gross consumer prices stated in Hungarian forints and include value added tax, unless the Webshop expressly states otherwise.

8.2. Delivery, cash-on-delivery, packaging and other optional service charges are displayed separately before the order is finalised.

8.3. Where a Product is subject to a mandatory redemption fee (deposit fee), the Webshop automatically adds the applicable fee to the order total. The final amount payable includes the redemption fee, which is displayed as a separate item in the basket and before the order is finalised.

8.4. Discounts, coupons and promotions are governed by the rules of the relevant offer. Unless otherwise stated, discounts may not be combined, exchanged for cash or used after expiry.

8.5. The Service Provider may change prices prospectively. Any such change shall not affect orders already accepted.

9. Payment terms

9.1. The payment methods available in the Webshop are:

  • online card payment and other electronic payment methods available at checkout through Shopify Payments;
  • bank transfer to the Service Provider’s BinX account number 30400001-00000000-62570086; the order number and the Customer’s name must be stated in the payment reference;
  • cash on delivery, where made available at checkout; any cash-on-delivery handling fee charged by the carrier may be passed on to the Customer and is shown separately before finalising the order;
  • cash or card payment upon Gourmet Moments local delivery or personal collection at 4211 Ebes, Rákóczi út 6.

9.2. Online payment transactions are processed by Shopify Payments and its participating financial service providers. The Service Provider does not receive or store full payment-card details. The payment methods actually available for an order are shown at checkout.

9.3. In the case of bank transfer, performance of the order normally begins after the amount has been credited, unless the Service Provider indicates otherwise.

9.4. For cash-on-delivery orders, the Customer pays the purchase price, delivery charge and any separately disclosed cash-on-delivery handling fee upon delivery.

9.5. For Gourmet Moments local delivery and personal collection, payment may be made in cash or by bank card.

9.6. The Service Provider issues an electronic invoice and sends it to the email address provided where permitted by the invoicing system and applicable law. By accepting these Terms, the Customer consents to electronic invoicing.

10. Delivery, collection and transfer of risk

10.1. Delivery territory: Hungary.

10.2. Available delivery and collection methods are:

  • nationwide delivery by GLS, MPL or Foxpost, according to the options available at checkout;
  • Gourmet Moments local delivery within Debrecen and a 25 km radius of Debrecen, under the conditions displayed in the Webshop;
  • personal collection from the Gourmet Moments warehouse at 4211 Ebes, Rákóczi út 6. Personal collection is available only after prior confirmation and appointment.

10.3. The expected fulfilment time is 1–3 Business Days for Products in stock and generally 3–5 Business Days where stock replenishment is required. The parties may agree otherwise, particularly for pre-orders, large quantities or an individually scheduled Gourmet Moments delivery.

10.4. Stated delivery times are estimates unless the Service Provider expressly guarantees a deadline. The Service Provider performs without undue delay and, in consumer contracts, no later than the statutory deadline.

10.5. In a consumer sale, risk passes to the Consumer when the Consumer, or a third party designated by the Consumer other than the carrier, takes physical possession of the Product. If the Consumer independently appoints a carrier not offered by the Service Provider, risk may pass upon delivery to that carrier.

10.6. The Customer must provide a delivery address and contact details at which the parcel can be delivered lawfully and safely. Alcoholic products may not be left unattended where age-verification requirements or the carrier’s rules prohibit this.

10.7. The Customer should inspect the external condition of the parcel upon receipt. In the case of visible damage, wet packaging or leakage, the Customer should request a damage report and, where possible, take photographs.

10.8. Personal collection is available on Business Days between 10:00 and 17:00, or at another time agreed in advance. The Service Provider normally confirms that the order is ready for collection within 24 hours, subject to stock availability. The order is held for three days after confirmation unless otherwise agreed. On-site purchasing without a prior online order is not available.

11. Failed delivery

11.1. If delivery is unsuccessful, the carrier may make another delivery attempt, leave a notification or return the parcel in accordance with its own terms.

11.2. If delivery fails for a reason attributable to the Customer, including an incorrect address, unavailability, unjustified refusal to accept delivery, absence of an adult recipient or a false age declaration, the Service Provider may charge the actual and evidenced additional costs.

11.3. Reshipment of a returned order may be conditional upon advance payment of the costs incurred. The Service Provider shall in all cases comply with the statutory rules on consumer withdrawal and refunds.

12. Damaged, broken or leaking bottles

12.1. If a parcel or bottle arrives damaged, broken, leaking or incomplete, the Customer should report the issue as soon as reasonably possible after discovery, without prejudice to statutory claim periods.

12.2. To facilitate prompt handling, the Customer should provide the order number, the name and quantity of the affected Product, a short description and photographs of the outer and inner packaging, label and damage. The absence of photographs does not in itself prevent the exercise of statutory rights.

12.3. Depending on the circumstances, the Service Provider may offer replacement, supplementary delivery, a price reduction or a refund. This does not restrict the Customer’s statutory rights.

12.4. For safety reasons, broken glass, contaminated liquid or dangerously damaged packaging need not be returned if the Service Provider confirms this in writing. Where it is safe to do so, the Customer should await the Service Provider’s instructions before disposing of the parcel.

13. Storage, consumption and wine faults

13.1. After receipt, the Customer must store wine appropriately for its nature, protected from heat, frost, direct sunlight, strong odours and significant temperature fluctuations. Any specific storage or serving instructions stated on the Product page or label shall prevail.

13.2. The Service Provider is not liable for deterioration caused by improper storage by the Customer, freezing, overheating, sunlight, mechanical damage or improper handling after opening where these circumstances can be shown to have caused the defect.

13.3. Wine faults may include abnormal cork taint, oxidation, volatile acidity, unintended refermentation, leakage or another condition inconsistent with the nature of the Product. Natural sediment, tartrate crystals, slight haze or variations characteristic of natural wine do not necessarily constitute a wine fault.

13.4. In the event of a quality complaint, the Customer should, where possible, retain the bottle, closure, lot identifier and remaining wine until the investigation is completed and provide details of opening, storage and the circumstances in which the issue was detected.

13.5. The Service Provider may request return of the Product or a sample for examination, without disproportionately restricting the Customer’s statutory rights. Where the complaint is justified, the Service Provider bears the necessary return costs.

13.6. Tasting notes, food-pairing suggestions and occasion recommendations displayed in the Webshop are intended to support cultured wine enjoyment and shared moments. They do not encourage excessive alcohol consumption; moderation is a core principle of all communications by the Service Provider.

14. Gift packages and multi-product bundles

14.1. The content of a gift package or multi-product bundle is determined by the product page and the order confirmation.

14.2. If an item in a package becomes unavailable, the Service Provider may substitute it with a similar or higher-value item only with the Customer’s prior consent.

14.3. Where a discounted package was sold as a single composite Product, withdrawal may require the entire package to be returned. Where the items were sold separately, withdrawal may be exercised on a Product-by-Product basis. The specific classification depends on the offer shown on the product page and in the order.

14.4. In the case of an incomplete or damaged gift package, any refund shall be determined in accordance with applicable law and the actual reduction in value.

15. Right of withdrawal

15.1. In the case of a distance contract, a Consumer has the right to withdraw without giving reasons within 14 days from receipt of the Product. Where several Products are delivered at different times, the period runs from receipt of the last Product.

15.2. The Consumer may exercise the right of withdrawal by an unequivocal statement, using the model form in Annex 1, by email, by post or, from 19 June 2026 where the contract was concluded online, through the continuously available “withdraw from the contract” function in the Webshop.

15.3. The online withdrawal function requests the information required by law and provides a separate “confirm withdrawal” function. The Service Provider acknowledges receipt of an online withdrawal without delay on a durable medium.

15.4. Withdrawal is exercised within the deadline if the Consumer sends the statement before expiry of the 14-day period.

15.5. The right of withdrawal does not apply in the cases specified by law, including non-prefabricated goods made to the Consumer’s specifications or clearly personalised; goods liable to deteriorate or expire rapidly; and sealed goods which are not suitable for return for health-protection or hygiene reasons and were unsealed after delivery, where the Product genuinely falls within the relevant exception.

15.6. The statutory exception applicable to alcoholic beverages applies only where the price was agreed when the sales contract was concluded, delivery can take place only after 30 days, and the value depends on market fluctuations beyond the trader’s control. This exception does not generally apply to wines supplied by the Webshop within the usual short delivery period.

15.7. Opening a bottle does not automatically extinguish the right of withdrawal in every case. However, the Consumer may be liable for any reduction in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Product. For an opened beverage, the reduction in value may be substantial or equal to the full Product value where the Product can no longer be safely and lawfully resold.

15.8. Where the Product is defective or affected by a wine fault, the statutory conformity rules apply instead of the reduction-in-value rules governing withdrawal without cause.

16. Returns and refunds

16.1. Following withdrawal, the Consumer must return or hand over the Product without undue delay and no later than 14 days after communicating the withdrawal.

16.2. Return address: 4211 Ebes, Rákóczi út 6., Piac Shop No. 5, Hungary.

16.3. The direct cost of returning the Product is borne by the Consumer unless the Service Provider has agreed to bear it or the return is due to defective performance.

16.4. Bottles must be packaged safely and adequately protected against breakage and leakage. The Service Provider is not required to accept parcels sent cash on delivery or with postage due.

16.5. The Service Provider refunds all amounts paid by the Consumer, including the cost of the least expensive standard delivery method offered, within 14 days of becoming aware of the withdrawal. The refund may be withheld until the Product is received or the Consumer provides credible evidence of return, whichever occurs first.

16.6. The refund is made using the same payment method as the original transaction unless the Consumer expressly agrees otherwise and incurs no additional cost as a result.

16.7. Where the Consumer selected a delivery method more expensive than the least expensive standard method offered by the Service Provider, the additional cost need not be refunded.

17. Legal guarantee of conformity and product liability

17.1. In the event of defective performance, the Consumer may assert legal guarantee rights under the Hungarian Civil Code and applicable consumer-protection legislation.

17.2. The Consumer may primarily request repair or replacement unless the chosen remedy is impossible or would impose disproportionate additional costs. Repair is generally not meaningful for wine and other consumable Products; in such cases replacement, price reduction or termination of the contract may be available subject to statutory conditions.

17.3. The Consumer may not terminate the contract for a minor defect. The Service Provider bears the burden of proving that the defect is minor.

17.4. The Consumer must notify the defect without undue delay after discovery. The applicable deadlines and evidentiary rules are determined by the legislation in force.

17.5. In the case of defective movable goods, the Consumer may also assert product-liability rights against the manufacturer or distributor under the conditions laid down by law.

17.6. Mandatory commercial-guarantee rules apply only to Products classified as durable consumer goods subject to mandatory guarantee under the legislation in force. Wine and other consumable beverages are generally not subject to a mandatory commercial guarantee.

18. Complaints and dispute resolution

18.1. The Customer may submit a complaint using the following contact details:

18.2. The Service Provider examines and, where possible, remedies an oral complaint immediately. If this is not possible, or the Customer disagrees with the handling, the Service Provider prepares a written record and proceeds in accordance with applicable law.

18.3. A written complaint is answered in writing, substantively and in a verifiable manner within 30 days of receipt. Any rejection is reasoned and includes information on the available authority or conciliation forum.

18.4. In a consumer dispute, the Consumer may apply to the conciliation body competent for their residence or place of stay, or, at their choice, the conciliation body competent for the Service Provider’s registered office. The Service Provider cooperates in conciliation proceedings.

18.5. The Consumer may initiate consumer-protection proceedings before the competent government office. The consumer-protection authority competent for the Service Provider’s registered office is the Hajdú-Bihar County Government Office, Department of Transport, Technical Authorisation, Metrology and Consumer Protection, Consumer Protection Unit; address: 4025 Debrecen, Széchenyi utca 46.; telephone: +36 52 533 924; email: fogyasztovedelem@hajdu.gov.hu. Administrative proceedings do not replace the settlement of individual civil claims before a court or conciliation body.

18.6. The parties shall seek to resolve disputes amicably. If this is unsuccessful, the Consumer is entitled to bring proceedings before a court.

19. Customers who are not Consumers

19.1. Rights granted to Consumers by mandatory law, including the 14-day right of withdrawal without cause, apply to a Business Customer only where expressly provided by law or separately undertaken by the Service Provider.

19.2. A Business Customer must inspect the Product on receipt and notify any apparent quantity or quality issue without undue delay.

19.3. The Service Provider and a Business Customer may depart from individual provisions of these Terms in a separate written agreement. In the event of a discrepancy, the individual agreement shall prevail.

19.4. Purchases for resale or export are permitted only with the Service Provider’s prior written consent and under separate terms.

20. User accounts, reviews and prohibited conduct

20.1. The Customer may not use the Webshop for unlawful, misleading or harmful purposes, for automated data extraction, or in any way that jeopardises system security.

20.2. Prohibited conduct includes providing false information, impersonating another person, fraudulent payment, sending unsolicited communications, introducing malicious code, obstructing the operation of the Webshop, and using unauthorised robots, scrapers or automated agents.

20.3. By submitting a Product review or other user content, the Customer confirms that they are entitled to publish it and that it does not infringe third-party rights. The Service Provider may remove unlawful, offensive, misleading, promotional or irrelevant content.

20.4. By submitting a review, the Customer grants the Service Provider a non-exclusive, worldwide, royalty-free licence to display it in the Webshop and on Gourmet Moments marketing channels, subject to personality and data-protection rights.

21. Intellectual property

21.1. The content of the Webshop, including the brand name, logo, text, images, graphics, videos, layout and database, is the intellectual property of the Service Provider or its authorised partners and is protected by law.

21.2. Except for private browsing, the content may not be copied, distributed, modified, sold, downloaded in bulk or used for business purposes without the prior written consent of the relevant rights holder.

21.3. Trade marks and content belonging to wineries, manufacturers, Shopify and other third parties remain the property of their respective owners.

22. Data processing, cookies and Shopify

22.1. Processing of personal data is governed by the Webshop’s Privacy Policy in force from time to time: https://www.gourmet-moments.hu/policies/privacy-policy

22.2. Information on the use of cookies and similar technologies, and on granting, refusing or later changing consent, is provided through the cookie and consent-management interface displayed in the Webshop.

22.3. The Webshop operates on the Shopify technology platform. Shopify and applications connected to the Webshop may process data for service provision, security, payment, analytics and development in accordance with their own privacy terms and the Service Provider’s Privacy Policy.

22.4. The Webshop may use external payment, logistics, invoicing, newsletter and analytics service providers. Their current scope and data-processing roles are described in the Privacy Policy.

23. Liability, force majeure and third-party services

23.1. The Service Provider does not exclude or limit liability to an extent prohibited by mandatory law, in particular liability for intentional damage or for a breach of contract causing harm to life, physical integrity or health.

23.2. Operation of the Webshop may be temporarily interrupted due to maintenance, malfunction, cyberattack, service-provider failure or another unavoidable cause. The Service Provider takes reasonable measures to restore the service.

23.3. The Service Provider is not liable for delay or non-performance caused by an event outside its control that was not foreseeable when the contract was concluded and could not reasonably be avoided, including natural disasters, extreme weather, transport disruption, official measures, strikes, epidemics, war, power outages or major IT failures.

23.4. The Webshop may contain links to third-party websites or services. The Service Provider is not responsible for the content or operation of those external interfaces, without prejudice to its own contractual obligations.

23.5. Tasting, food-pairing and consumption recommendations relating to wines are provided for information only and do not constitute medical advice.

24. Amendments and severability

24.1. The Service Provider may amend these Terms prospectively, in particular due to changes in legislation, authority practice, service processes, payment methods or delivery methods.

24.2. Amended Terms apply from the effective date stated in them. Contracts already concluded are generally governed by the Terms in force when the order was placed.

24.3. Material amendments are communicated to affected persons in the manner required by law.

24.4. If any provision of these Terms is invalid or unenforceable, this does not affect the validity of the remaining provisions. The relevant mandatory legal rule shall apply in place of the invalid provision.

25. Governing law, language and final provisions

25.1. These Terms and contracts concluded under them are governed by Hungarian law, including in particular the Hungarian Civil Code and the rules applicable to electronic commerce, consumer protection and distance contracts.

25.2. A Consumer may also benefit from the mandatory consumer-protection provisions of the state of their habitual residence even where Hungarian law has been chosen.

25.3. In consumer disputes, jurisdiction is determined by the mandatory procedural rules in force. The Service Provider does not impose exclusive jurisdiction on the Consumer in favour of the courts at the Service Provider’s registered office.

25.4. The Hungarian-language Terms are the primary version. The English or any other language translation is provided for information, and the Hungarian text shall prevail in the event of a discrepancy, without prejudice to mandatory law.

25.5. Effective date of these Terms: 20 July 2026.
